The National Communications Authority (NCA) has issued a Notice of Proposed Licence Amendment to Next-Gen Infraco (NGIC), signaling plans to remove the 5G exclusivity clause in NGIC’s operating licence.
The proposed amendment, issued in accordance with Section 14 of the Electronic Communications Act, 2008 (Act 775), is intended to promote competition and innovation within Ghana’s 5G telecommunications space. The Authority said the decision is aimed at enhancing consumer choice, improving service quality, accelerating digital transformation across the country, and ensuring the efficient use of spectrum as a national resource.
Under the law, the proposed amendment will take effect 90 days from the date of the notice unless NGIC submits representations within the statutory period that lead to a review of the decision.
The NCA assured the public that the process has followed due regulatory procedure and remains consistent with its mandate to safeguard national interests while promoting a competitive telecommunications environment.
In a related development, the NCA disclosed that NGIC has installed 49 operational 5G sites across Ghana. The distribution includes 43 sites in the Greater Accra Region, two in the Ashanti Region, and one site each in the Western, Northern, Bono, and Central regions.
The Authority also indicated that NGIC is currently in default of its licence fee instalment obligations as required under its licence conditions. The NCA stated that the matter is being handled in accordance with the relevant licence terms and statutory provisions.
